The hour-long webinar will cover the recent decision in the case of Hall vs. Nationstar Mortgage [4] in the U.S. District Court, Eastern District of Pennsylvania. In that case, plaintiff Virginia Hall's class action alleged that Nationstar and others violated the Fair Debt Collection Practices Act by making misleading statements regarding a foreclosure notice. Hall also alleged in an individual action that the defendant violated the FDCPA by contacting her directly regarding a debt when they knew she was represented by counsel. The court denied the defendants' motion for summary judgment on both claims but sua sponte dismissed the individual action without prejudice.

The webinar will include a discussion between the WALZ Compliance team and guest panelists on ways servicers can prevent litigation risk when sending Pennsylvania Act 6 and Act 91 [5] notices. Amendments to these laws were enacted in 2008 to provide additional protections to borrowers facing foreclosure and heighten regulatory scrutiny of mortgage brokers and appraisers.
