The BDF Law Group: Texas Legislative Update

real-estate-law-twoThe 84th Texas Legislative session passed three bills that directly affect the foreclosure process. HB 2067 allows a lender to unilaterally waive a prior acceleration and stop the running of the statute of limitations. HB 2066 creates a mechanism for lenders to rescind a foreclosure sale within 15 days without penalty. HB 2063 eliminates the need for a separate appointment of trustee and allows a law firm to make the appointment via the notice of sale. In addition bills relating to surviving spouses, foreclosures of mineral leases, eviction appeals, and transfer on death deeds were passed, and may affect servicers.
