Foreclosure Litigation Declines in Q1, Activity Still High

Among all cases, those related to foreclosures were the most active, with 74 cases moving forward, according to first-quarter data from Mortgage Daily. However, that was still a drop from that category's peak. An accompanying white paper released by Ballard Spahr LLP suggests the decline in foreclosure-related cases has more to do with the drop in foreclosure filings during the period. Cases involving loan modifications also decreased as foreclosure filings normalized--though dissatisfaction still remains high.

Foreclosure Crisis Takes Toll on Renters

Industry data suggests by the end of 2010, more than 5 million homes had been foreclosed as a result of the recent housing crisis, and some anticipate another 8 million to 10 million more foreclosures will make their way through the pipeline over the next few years. However, as the National Law Center on Homelessness and Poverty (NLCHP) points out, this is only part of the picture. About 20 percent of all foreclosed properties have been rental properties, according to a recent NLCHP report. In fact, about 40 percent of all families evicted in foreclosure are renters not owners, according to NLCHP.

Foreclosure Starts Plunge to 71-Month Low, REO Activty Increases

A significant drop in foreclosure starts brought down foreclosure activity in November, according to a foreclosure report from RealtyTrac. Foreclosure starts were filed on 77,494 U.S. properties in November, a 71-month low and the lowest level since December 2006, RealtyTrac reported Thursday. The decrease represents a 13 percent drop from October and a 28 percent decline from November 2011. While foreclosure starts fell, bank repossessions rose annually for the first time in 25 months.

CoreLogic: 58,000 Homes Lost to Foreclosure in October

There were 58,000 foreclosures completed in the United States during the month of October, CoreLogic reported Monday with the release of its latest National Foreclosure Report. October's tally was down 17 percent from last year when 70,000 foreclosures were completed during the month. On a month-over-month basis, completed foreclosures fell 25 percent after September's count was revised upward from the previously reported 57,000 to 77,000. CoreLogic says the larger-than-usual revision was due to an annual online auction of delinquent tax properties in Wayne County, Michigan, that weren't included in the earlier assessment.

Los Angeles Sues U.S. Bank Over Deteriorating Foreclosures, Evictions

Los Angeles' city attorney, Carmen A. Trutanich, announced his office filed a lawsuit against US Bank over allegations that the bank allows its foreclosures to deteriorate into slum conditions and executes illegal evictions, according to a release Tuesday. The complaint cites more than 170 properties as examples of US Bank's illegal conduct. US Bank denied its role in the complaints, stating, ""We are extremely disappointed that the City Attorney's office has chosen to file this lawsuit. The city attorney has chosen the wrong party - we are not the owners of the properties, nor are we responsible for the servicing of the properties.""

Consumer Rights Group: Outdated Laws Are Causing Second Crisis

According to a report from NCLC, laws in many states allow local governments to sell property through a tax lien foreclosure process if the owner falls behind on property taxes. A tax lien may be started over nonpayment of a small delinquent tax bill and then sold at a tax lien sale for the back taxes owed on the property. If the homeowner fails to buy back the property, the purchaser may acquire the home for very little and then resell it for a huge profit.
